Current Practice

Mr. Pierce practices in the areas of domestic and international patent preparation and prosecution. Besides involvement in patent prosecution, his practice also includes trademark and copyright prosecution, issues relating to patent and trademark infringement, unfair competition, theft of trade secrets, preparing and negotiating licensing agreements, as well as related litigation matters. In particular, Mr. Pierce spends a great deal of time counseling clients on the interplay between the value of intellectual property rights, capturing, developing and/or expanding market share, and the potential increase in a company’s valuation associated therewith, as well as offering advice to the entrepreneurial start-ups and emerging growth companies.

 
Background

Since joining the legal profession, Mr. Pierce has assisted clients in procuring patent protection, both domestic and international, in a wide variety of technological arts and methodologies. These areas include chemical and chemical processes, biological, microbiological, biotech, pharmaceutical, dietary and nutritional supplements, medical and dental devices and techniques, exercise equipment, printing processes and related apparatus, in addition to various mechanical and manufacturing processes and products.

 

As a result of his extensive intellectual property and legal experience, Mr. Pierce spends a good portion of his time meeting with clients to discuss and develop individualized strategies for their intellectual property assets (e.g., patents, trademarks, copyrights, trade secrets, know-how and technology licensing, employer/employee asset protection agreements, confidentiality disclosure agreements, etc.) in such a way as to help identify, create, maintain, and manage in order to increase the client's market share and capture increased profit margins.

Mr. Pierce is also involved in representing clients in dispute resolution matters, including litigation, meditation, and arbitration proceedings involving various types of intellectual property assets.

 

From 1997-1999, Mr. Pierce served as the Vice Chair and Chair of the Intellectual Property Section of the Utah State Bar. Mr. Pierce has also been recognized as a "Super Lawyer" by his peers in the area of Intellectual Property and was recently awarded the  2016 Client's Choice Award by Avvo based on 5 star client reviews.
